Did you know that Duties have changed, fines have tripled and new processes must be in place for workgroups, who elect Health & Safety Representatives (HSR)?

New outcome focussed, positive duties:

Persons Conducting a Business or Undertaking (PCBU) will have the 'Primary Duty' to 'ensure the safety of all persons', so far as is reasonably practicable.

Officers will have a specific duty to show Due Diligence. This means Directors, Secretaries, CEOs, CFOs, COOs etc. can not only hold concurrent duties in some instances as both Officer and PCBU but can also be held personally liable for ‘failing to ensure’ the workplace safety of ALL persons affected by your business activities.

Personal liability even if no offence by Company!
Maximum fines triple to $3M & 5 Years Jail

• New terminology
• New Codes of Practice - which can be used against you as evidence
• Behavioural hazards must also be addressed - safety culture
• New health monitoring requirements
• Consultation, co-operation and coordination with stakeholders required
• 'Proactive' and 'Reactive' systematic approach to be in place
